Would it be okay if i do this?
I was thinking i might make a 3D game set in kolyma....would it be okay if i do this?
I would only add (probably more this is all i can think of i will ask any more if i can add): The count and his place, hagatha, the town, the place up in the sky, maybe the merpeoples realm.
But i'm not adding king grahm so this is not a KQ game....
If not it's okay i can come up with things....oh and if there is anything that might not be a good idea for me to put in from just tell me

That's a good question. I don't who would have the rights since Sierra is gone and AGDI here didn't seem to have any copyright issues...
Sorry I just saw this topic now but I just got back from putting The Father's curse upon somone who put a SPAM topic in the Paper Mario 2 board at GameFAQS!
EDIT: Just put the curse on someone at GameFAQS who insulted another user.

Unless you meant Wookie's story elements, which he's fond of protecting I guess, no you don't need any permission from AGDI for that. An interesting situation about the copyright issues, though. Then again, Sierra may be gone but the label still exists. Vivendi might still care somehow in some way some where out there....in the vast expanse of possibilities.....wow that was quite a poetic perspective I just made...I'm rather proud of that.

The King's Quest intellectual property is owned by Vivendi Universal Games who bought Sierra a few years back. They're the only people legally authorised to grant you permission to use that intellectual property. (we're not)
Assuming they don't care is a rather rash decision, btw. Any company cares about protecting their copyrights and trademarks.

I wouldn't think anybody would care since it's only a fan game that going to be made on MY website and i'm not going to sell it i just want to make a 3D kolyma fan game that has nothing to do with kings quest at all....all i am asking is if i can set it in kolyma....and a few other things IN kolyma that are kinda essencal to setting it in kolyma....

Uhanimar, he's the simple facts. If you set your game in Kolyma then the people who own the intellectual copyrights to the Kings Quest series (Sierra / VU) could sue you. Using someone else's ideas for something is a violation of copyright law.
That said, the question remains, will they sue you? Probably not, particually if you're not making any money off the product. They could issue you with a polite "cease and desist" letter, which is more likly.
Honestly, if you only want to set the game in an imaginary land, then make up your own world. Thats my suggestion. It's also more rewarding in the end.
And Rog, drawing a picture of Mickey Mouse and uploading it on the internet is a breach of Disney's copyrights. They could sue, they could issue you with a C&D. It doesn't mean they will, but they are perfectly within their rights to do so. So your argument isn't valid.

I've never got the idea from Erpy's posts that he had anything against other projects. He was simply answering Uhanimar's question. And his answer was that:
1) VU has all the right to sue/close down any fan game or art or anything related to their products. Whether they'll do it, nobody knows.
2) If Uhanimar's gonna create an original game he should keep it completely original. That's the logical thing to do.
Fan projects had a good run, but how long this 'luck' will continue...........
