The glass flask you need for spellcasting is not the bottle in the hole.
It's actually in exactly the place you'd expect a glass flask used for spellcrafting to be. Look more closely and click the HAND icon on more places in the most likely location.

No. In theory, if you've stolen something from that guard's home and you show it to him, he catches you. In practice, this happens with every item, I think. This has been reported.
